ACKNOWLEDGMENT OF RISKS & HAZARDS, LIABILITY RELEASE & AGREEMENT NOT TO SUE
As a condition of receiving or purchasing a Granite Gorge Mountain Park (the "Park") scenic chairlift ride, I, the Purchaser, agree to the following conditions and RELEASE OF LIABILITY:
I understand that the riding of lifts, hiking and other on mountain and associated activities ("Activities") involve inherent dangers and risks, including but not limited to, exposure to: various terrain and conditions including rocks; trees; stumps; other forms of forest related structures; and other on mountain activities such as mountain biking, maintenance operations, etc., and other on-hill activities.
I agree to assume all risk of injury, death and property damage that may result from my participation in Activities at the Park. To the fullest extent of the law, for myself and/or my child, I HEREBY RELEASE AND FOREVER INDEMNIFY, DEFEND AND HOLD HARMLESS Granite Gorge Partnership LLC, doing business as Granite Gorge Mountain Park and its respective parents, subsidiaries, affiliates, assigns, directors, owners, partners, members, officers, employees, agents, contractors and volunteers, including the extended family members thereof, (collectively the RELEASEES"), from any and all claim, loss, damage or penalty of any kind arising out of my or my child's participation in Activities at the Park.
I understand that I, and on behalf of any of my child, am accepting all risk associated in undertaking Activities at the Park which includes any and all risk of property and physical damage, personal injury or death in connection with participation in Activities at the Park. I agree to refrain from any misconduct that may lead to reckless behavior while performing the Activities and agree to refrain from any conduct of any type that would cause fear, harm or otherwise detract from the inclusive environment being promoted at the Park (collectively the "Respect Policy"). Park management reserves the right to revoke any Purchaser's ticket without refund for violations of this Respect Policy or any other Park policies.
I give full permission for use of my image, including the use of my child's image, via photograph or video and on any form of media as such image relates to participation in Activities at the Park.
This agreement shall be governed by the Laws of the State of New Hampshire and jurisdiction is submitted to the federal and state courts thereof and none other. If any part of this agreement is deemed unenforceable, all other parts shall be given full force and effect.
I have read and understand the above terms and conditions and agree to all conditions of this RELEASE OF LIABILITY ON BEHALF OF MYSELF AND/OR MY CHILD.
